１．ロシア政府の知財関連決議／報道に見る商標問題　　　パートナー・弁理士　長谷川洋

（１）ご存じの通り、ロシアによるウクライナ侵攻に対して、西側諸国による経済制裁が行われ、ロシアの７つの銀行が国際銀行間通信協会（SWIFT）から排除された。日本もこれに歩調を合わせると公表した。日本の三大都市銀行は、2022年3月21日時点で議論中のようだが、ゆうちょ銀行、楽天銀行などの一部銀行では、ロシアへの送金を停止することを公表している。このような西側諸国の経済制裁に対して、当然、ロシアも黙っていない。知財に関するロシアの動きについては、日本でもいくつかの報道がされている。以下に２つほど紹介したい。

（２）ロシア政府の知財関連決議 　2022年3月7日、ロシアは、国家安全保障等のために権利者の同意なく特許権等の強制実施権を許可したときの対価に関するロシア連邦政府令（2021年10月18日付け）に対して、さらなる追加規定を設けた。それは、ロシアからみて非友好的な国（日本も含まれる）によるロシア特許等については、強制実施権の対価を０％とするものである（注１，注２）。注２の公表文のAI翻訳（DeepL）を用いた英訳を最後に掲載する（注３）。これは、例えば、日本企業がロシアで特許権を有している場合、ロシア政府が強制実施権を認めたときには、その特許権者たる日本企業に対価を払うことなく無料実施を認めるという規定である。

（３）報道に見る商標問題 　2022年3月21日の報道番組によると、同月9日にマクドナルドがロシアにおける店舗を閉鎖した3日後に、「ワーニヤおじさん」というロシアのファストフードのフランチャイズが赤の背景にマクドナルドのM字ロゴを横倒しにして「B」の字に似せた商標を出願したとのことである。ネットで探すと、これに関連するネット記事もあった（注４）。マクドナルドの商標とワーニャおじさんの商標が類似していないなら問題はない。しかし、マクドナルドの商標の著名性からすれば、個人的ではあるが、類似していると思う。

The Government of the Russian Federation decides:
1. Par. 2 of the Methodology for Determining the Amount of Compensation
Paid to the Patentee under Decision to Use an Invention, Utility Model or Industrial Design without his Consent and the Procedure for its Payment,approved by Decree of the Government of the Russian Federation No.1767 of October 18, 2021 "On Approving the Methodology for Determining the Amount of Compensation Paid to the Patentee under Decision to Use an Invention, Utility Model or Industrial Design without his Consent, and the Procedure for Payment" (Collection of Legislative Acts of the Russian Federation, approved by the Decree of the Government of the Russian Federation on December 20, 2012).
With regard to patentees associated with foreign states which commit unfriendly acts in relation to Russian legal entities and individuals (including if such patentees have citizenship of these states, the place of their registration, the place of their preferential business activity or the place of their preferential profit from their activity is these states), the amount of compensation shall be 0 percent of the actual revenue of the person who exercised the right to use the iso.
2. This decree shall enter into force on the date of its official publication.
